Intellectual Property Complaint & Takedown Procedure

1. Purpose

KitaKreativ respects intellectual property rights and expects Sellers to do the same.
This Procedure outlines how rights holders may submit complaints regarding alleged copyright, trademark, or other intellectual property infringements on the Platform.

2. How to Submit a Complaint

  • Intellectual property complaints must be submitted in writing to: support@kitakreativ.com
  • Complaints must include all of the following:
    • Identification of the copyrighted work, trademark, or protected material claimed to be infringed.
    • The exact URL(s) of the allegedly infringing listing(s).
    • A description of how the material infringes the complainant’s rights.
    • Proof of ownership (e.g., registration number, official website link, or documentation).
    • Full name and contact information of the complainant.
    • A statement that the information provided is accurate and that the complainant is authorized to act on behalf of the rights holder.
  • Incomplete complaints may not be processed.

3. Review & Interim Action

  • Upon receipt of a valid complaint:
    • KitaKreativ may temporarily remove or disable access to the allegedly infringing content.
    • The Seller will be notified of the complaint.
    • The listing may remain disabled while it is under review.
  • KitaKreativ reserves sole discretion in determining appropriate interim action.

4. Seller Notification & Response

  • The Seller will be informed of:
    • The nature of the complaint
    • The content affected
    • The option to submit a response
  • Sellers may provide:
    • Evidence of ownership
    • Proof of license or authorization
    • Explanation disputing the claim
  • Failure to respond within a reasonable timeframe may result in permanent removal.

5. Counter-Notice Procedure

  • If a Seller believes the complaint was submitted in error or that they have lawful authorization, they may submit a written counter-notice including:
    • Identification of the removed material.
    • A statement explaining why the content does not infringe.
    • Supporting documentation or licensing proof.
    • Seller’s full name and contact details.
    • A statement made in good faith that the information provided is accurate.
  • KitaKreativ may review the counter-notice and determine whether to reinstate the content.
  • KitaKreativ is not obligated to restore content if legal uncertainty remains.

6. Repeat Infringer Policy

  • KitaKreativ maintains a zero-tolerance policy for repeated intellectual property violations.
  • Accounts that receive multiple valid complaints may be:
    • Temporarily suspended
    • Permanently terminated
    • Restricted from future registration
  • Determinations are made at KitaKreativ’s sole discretion, and decisions shall be deemed final.

7. Platform Role & Limitation of Liability

  • KitaKreativ operates as an online intermediary marketplace.
  • KitaKreativ:
    • Does not pre-screen all listings
    • Does not guarantee non-infringement
    • Does not independently verify IP ownership
    • Is not responsible for Seller misconduct
  • All intellectual property responsibility remains with the Seller.
  • KitaKreativ may cooperate with rights holders and legal authorities where required.

8. Good Faith Requirement

Submitting fraudulent or bad-faith intellectual property complaints may result in appropriate action, including account restriction.
