KitaKreativ is a curated, handmade-focused marketplace dedicated to original, independently created works. By listing any product on the Platform, Sellers agree to comply with this Policy in full.

KitaKreativ reserves the sole and absolute discretion to determine product eligibility at any time.

• 2.1 Original Creation
  • The product must be:
    • Designed, handmade, or substantially transformed by the Seller; and
    • The result of significant human creative input, and
    • Not merely a finished commercial product acquired for resale.
• 2.2 Ownership & Legal Right
  • The Seller must:
    • Own the intellectual property rights; or
    • Possess a valid commercial license granting the right to sell the product.
• KitaKreativ does not independently verify intellectual property ownership of every listing. The Seller bears full legal responsibility for any infringement claims.

• Adding a ribbon to a factory-made basket
• Repackaging wholesale goods
• Minimal modification of mass-produced items

• 4.1 Handmade Physical Works
  • Including but not limited to:
    • Ceramics
    • Textile arts (embroidery, macramé, weaving)
    • Handmade jewelry
    • Leather goods
    • Knitted or crocheted fashion
    • Original art and sculpture
    • Hand-bound stationery
    • Bespoke furniture and large-scale handcrafted décor
  • Sellers of large or fragile items are fully responsible for safe packaging, crating, insurance, and specialized logistics.
• 4.2 Vintage Handmade Items
  • Vintage items must:
    • Be at least twenty (20) years old;
    • Be handmade;
    • Be accurately described as vintage (not self-created).
  • Sellers must provide truthful provenance information. Misrepresentation may result in listing removal or account suspension.
• 4.3 Digital & Downloadable Products
  • Eligible digital products include:
    • Original illustrations
    • Printable planners
    • Original fonts
    • Self-designed templates
    • Craft tutorials or pattern PDFs
  • 4.3.1 Third-Party Tools & Assets
    • If digital products are created using platforms such as Canva, Procreate, Photoshop, or similar tools:
      • Sellers must comply with all third-party licensing terms.
      • Canva Pro elements or licensed stock assets must not be resold in violation of the original license.
      • Editable templates must not breach platform resale restrictions.
    • KitaKreativ is not responsible for third-party license violations committed by Sellers.
  • 4.3.2 Tutorials & Patterns
    • For digital tutorials (e.g., crochet patterns, weaving guides, PDF instructions):
      • The design and instructions must be original.
      • Sellers may not replicate protected brand designs.
      • “Inspired by” does not excuse infringement.
      • Use of copyrighted characters, trademarked logos, or protected fashion designs is strictly prohibited.
    • The Seller bears full responsibility for copyright compliance.
• 4.4 Handcrafted Wellness Products
  • The Platform allowed:
    • Handmade soaps
    • Candles
    • Aromatherapy products
  • Sellers must comply with all applicable local and international labeling, safety, and consumer protection regulations.
  • KitaKreativ makes no medical or therapeutic claims and assumes no liability for product efficacy or safety. Sellers assume full responsibility for compliance and claims.

• 5.1 Prohibition of Character-Based Replication
  • Sellers are strictly prohibited from listing, selling, or distributing any product, digital file, pattern, template, illustration, or tutorial that reproduces, imitates, or is substantially similar to copyrighted or trademark-protected characters, franchises, logos, or brand identities. This includes but is not limited to:
    • Crochet or knitting patterns replicating copyrighted characters
    • Sewing, embroidery, or craft templates depicting protected characters
    • Printable art featuring recognizable anime, cartoon, movie, or video game characters
    • Digital planners, stickers, or design templates incorporating protected character likeness
    • “Fan art” created without official license
    • “Inspired by” designs that are substantially similar to identifiable characters.
• 5.2 Recognition Standard
  • A design will be considered infringing if an ordinary person can reasonably identify the character, brand, or franchise from the final product — regardless of whether:
    • The Seller drew it independently
    • The Seller changed minor features
    • The Seller avoided using the official name
    • The listing states “fan art” or “inspired by”
  • Please take note that avoiding the character name does not eliminate infringement.
• 5.3 Tutorial & Pattern Liability
  • For instructional materials (including PDF patterns, digital tutorials, weaving guides, crochet diagrams, or step-by-step manuals), if the outcome of following the instructions results in a product that replicates or closely resembles a protected character, the listing is considered a violation of this Policy.
  • The format (pattern, tutorial, guide) does not exempt the Seller from copyright responsibility.
• 5.4 Use of Third-Party Franchises
  • Unauthorized use of characters or assets from entertainment franchises, including but not limited to animation, manga, anime, video games, films, and television series, is strictly prohibited unless the Seller possesses verifiable written commercial licensing authorization.
  • Sellers may be required to provide documentary proof of such authorization.
• 5.5 Zero-Tolerance Enforcement
  • KitaKreativ reserves the right to:
    • Immediately remove infringing listings
    • Suspend or permanently terminate Seller accounts
    • Respond to formal IP complaints or DMCA-style takedown notices
    • Cooperate with rights holders and legal authorities where required
  • Repeated violations may result in permanent removal from the Platform.
• 5.6 Platform Liability Disclaimer
  • KitaKreativ operates as an online marketplace and does not pre-screen all listings.
  • All intellectual property responsibility rests solely with the Seller.
  • The Platform shall not be liable for unauthorized use of copyrighted works, trademarks, or protected characters by Sellers.

• Currently restricted due to regulatory or liability concerns:
  • Food & beverages
  • Skincare & cosmetics (except soap and candles)
• KitaKreativ may revise category permissions at any time.

• The following are prohibited:
  • Commercial resale of finished wholesale goods
  • Print-on-Demand fulfilled entirely by third-party manufacturers
  • Mass-produced factory items without creative modification
  • Unauthorized use of copyrighted characters (e.g., anime, Disney)
  • Unauthorized use of celebrity likenesses
  • Unauthorized use of registered trademarks
  • Hate speech or discriminatory content
  • Illegal items, weapons, controlled substances
  • Sexually explicit materials
• Listings may be removed without prior notice.

• By listing a product, the Seller represents and warrants that:
  • The product complies with this Policy
  • The product does not infringe intellectual property rights
  • The product complies with applicable safety and trade laws
  • All descriptions are truthful and not misleading
• False representation may result in account suspension or termination.

• KitaKreativ reserves the right to:
  • Request proof of the production process
  • Request proof of licensing
  • Remove listings
  • Suspend or terminate accounts
  • Cooperate with legal authorities where required
• All enforcement decisions are at KitaKreativ’s sole discretion and shall be deemed final.

• For international sales, Sellers are solely responsible for:
  • Export compliance
  • Customs declarations
  • International product safety standards
  • Applicable tax obligations
• KitaKreativ does not guarantee regulatory compliance in foreign jurisdictions.

• KitaKreativ operates as an online marketplace platform.
• KitaKreativ:
  • Does not manufacture products
  • Does not independently inspect all goods
  • Does not guarantee intellectual property validity
  • Is not liable for Seller misconduct, regulatory violations, or infringement claims
• All legal responsibility for listed products remains with the Seller.
